  • Does Every Partnership Firm Need an Audit in Pakistan?

    A partnership firm is not automatically required to get its accounts audited under the Partnership Act, 1932, because the law mainly regulates the relationship between partners and their rights regarding books of account. However, under Section 92(1) of the Income Tax Ordinance, 2001, an important condition applies to AOPs having turnover of Rs. 300 million or above during the tax year or any preceding tax year. If such an AOP does not file audited financial statements along with its return of income, the partners may lose the exemption available on their share of profit, and that share may become taxable in their hands. Therefore, while audit is not mandatory for every partnership firm, it becomes practically necessary for large AOPs to protect the tax exemption of their partners.

  • Can a minor become a partner in a firm?

    A minor cannot become a full partner in a firm under the Partnership Act, 1932; however, with the consent of all existing partners, he may be admitted only to the benefits of the partnership under Section 30. In this arrangement, the minor is entitled to his agreed share of the profits and has the right to inspect the firm's accounts, but he is not personally liable for the business's debts or obligations. Upon attaining majority, the individual must choose within six months whether to become a full partner or withdraw from the firm; otherwise, he will be deemed to have become a partner by law.
